The Mobile Diagnostic & Service app (the “App”) is offered by Ford Motor Company Limited (“Ford”, “we”, “us” or “our”). This Privacy and Cookie Policy will help you understand what personal information we collect through the App, why we collect it and what we do with it.

Information we collect about you

We may collect the following personal information:

·         your name and contact information (such as your address, telephone number(s) and email address) and information about your business or employer

·         your user ID on the app

How we use your information

We use the information you provide to us to:

·         If requested, contact you in relation to a query and to offer technical support

·         Understand how you use the App to develop and improve our products, services and marketing strategies

·         Comply with our legal and regulatory responsibilities, to respond to legal process or requests for information issued by government authorities or other third parties, and to prevent and detect crime and fraud, or protect your, our or others’ rights

Our legal basis for using your information

The UK law concerning data protection allows us to use your personal information, provided that we have a legal basis for doing so. The legal basis that we rely on to use your information is that:

·         We have a legitimate interest in creating and managing your trade account and, if requested, contacting you with further information

·         We have a legitimate interest in assisting you with an order you would like to place, form completion or query raised on Live Chat on the App, and if requested, contacting you with further information

Sharing your information

We may share your information with third parties in the following circumstances:

·         Service Providers. We may share your information with our service providers). Where we do this, we ensure they are subject to agreements that oblige them to use the information only as we instruct, and to keep it securely

·         Law enforcement and other government agencies. ·         Asset purchasers: We may share your personal information with any third party that buys, or to which we transfer, all or some of our assets and business. In this case, we will use reasonable efforts to try to ensure that the entity to which your personal information is transferred uses it in a manner that is consistent with this Privacy Policy.

When we share your personal information, we will make sure that is used for purposes which are compatible with those described in this notice.

Overseas transfers

Your personal information will be treated in accordance with UK law concerning data protection and may be transferred and stored within the European Economic Area ("EEA"), as well as to countries outside the EEA (including to the USA). How long do we keep your information?

We only keep your information in identifiable form for as long as is reasonably necessary for the purposes for which it was collected and as required to comply with applicable legal and regulatory obligations. This generally means holding the information for as long as one of the following apply:

·         your information is reasonably required in order to manage your account on the App or respond to your requests

·         your information is reasonably required in order to protect and defend our rights or property (this will generally be the length of the relevant limitation period in your jurisdiction) or

Customer personal information

The App requires you to submit personal information relating to customers, including the VIN of their vehicle. You must:

·         ensure that customers are provided with the Fair Collection Notice below before their information is collected by the App.

·         only use the App and submit personal information relating to the customer which is necessary for the repair or service to be carried out;

Repair, diagnosis and servicing for your Ford vehicle

When you bring your Ford vehicle in for servicing or repair, certain information about you and your vehicle (" personal information") will be collected by Ford Motor Company Limited ("Ford", "we", "our " or " us").

When your Ford vehicle was manufactured it was assigned a unique number (the Vehicle Identification Number, or "VIN"). From the VIN we can tell certain information about your vehicle, including its model, age, the software it uses and its technical specifications. We can also use the VIN to find out what repair and servicing work has been carried out on your vehicle in the past.

In order to diagnose, analyse, repair or service your vehicle, the technicians working on it will need to collect the VIN together with certain diagnostic information and information about the current state of your vehicle (for example, what software versions it is using, its mileage etc.).

This information will be used by the Mobile Diagnostic & Service app offered by Ford so that the technicians working on your vehicle can be provided with vehicle-specific repair, maintenance and diagnostic information (such as diagnostic trouble codes) to assist them to diagnose, repair and/or service it, and to enable them to maintain their records.

·     European Commission and European Environment Agency.  In order to comply with our legal obligation to report emissions data, your vehicle’s identification number and lifetime fuel/ energy data will be collected from your vehicle’s modem (if it is a connected vehicle) and/ or each time your vehicle is serviced or repaired.  This data will be shared with the European Commission and European Environment Agency.  You can opt out of this data sharing by contacting your local Ford CRC.

·     companies or other organisations that we have engaged to provide services on our behalf such as web-hosting companies, mailing vendors, analytics providers and information technology providers;

·       companies in the Ford corporate Group for the purposes of research and development and analytics;

·       to companies in the Ford corporate Group and/or third parties where we believe this is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights, the rights of other companies in the Ford corporate group, or the rights of any third party.

Given the global nature of the system, VIN information is transferred to countries outside the European Economic Area by Ford. The countries to which we transfer your personal information may not be regarded by the European Commission as ensuring an adequate level of protection for personal information. We will ensure that where we transfer your personal information outside the EEA, we do so in accordance with applicable data protection laws.
